2 cars, who has right of way?

On a steep hill, normaly wide enough for 3cars but due to the snowbanks only 1 to 1 1/2 car wide ,one car going up the other going down who has the right of way? I say its the car going uphill has the right of way

In a world where humans are courteous to others one should GIVE that person the right away.;)

But I don't think there is any rules that imply.
 
I'd go with car up hill, just cause the fact you said it was snowy and I would imagine hes having a little bit harder of a time driving up snow rather than sliding down...but yeh f&ck it, run that SOB into a snowbank
 
Well I'm not sure exactly who has the right away, if im in my lincoln the guy coming down has the right away because his braking will be impaired. Chances are good if she hits the brakes while turning away from you, she's gonna put it sideways across the road and its gonna keep sliding If i'm in my truck my general rule of thumb get out of my way because i realyy don't care you can't afford a 4x4. I look forward to winter all year round just so i can take my truck out hours on end running through the snow. Nothing like a set of detroit truetrac 3.73's front and back with some 33" wrangler mtr's.

AFAIK, most states have a "last chance of avoidance" rule, so the person who starts up/down the hill first should have the right of way.
 
Sweet vid! That's about how I drive in the snow in my truck, except mine's only 2wd. I do my steering with the back wheels. :p

As far as the right of way thing, whoever gets to the hill first. But if you both get there at the same time, downhill wins because the guy going uphill will probably take 3 or 4 tries to get it right.
 
I can't speak for the law in other states but, in California, the law is, the one going uphill has the right of way.
I am not sure of the reasoning for that decision.
It has been a long time since I lived in the northeast, but if I remember correctly, in Mass, the car going downhill had the right of way, and the reasoning being it would be easier for a vehicle going uphill to slow and brake as oppossed to a vehicle going downhill.
Makes sense too me.

That is one of those fuzzy laws. Right of way is not something you are entitled to just because you arrive at the hill (or stop sign) first. One car is supposed to (in a described order) yield the ROW to the other. AFTER he does so the other car has the ROW. There are always extenuating circumstances in which the other person should have yielded to you but you must in fact break/yield to avoid hitting them. In no case are you allowed/entitled to hit someone just because they failed to give you the right of way.

In this case I would say the car going downhill should be required to yeild the ROW to the car traveling uphill... but not for multiple attempts.
 
As n8 noted, the law does not define who has the right of way, only who is to yield the right of way.

Personally, I follow the Alaskan Rules of the Right of Way--if you will lose, YIELD! :D
