the ashtray itself is okay but when you push it in it comes right back out it wont stay in. what could cause this?

The spring mechanism that pushes the ash tray out is just like a pen. It has a little flipper in there that just gets pushed by couple of rods one way then another to hold it in or let it slide back out. It can either get dirty and stick in a position that keeps it from locking the tray back or it can break.
Its not hard to take the whole thing out and just give it a look to find out which it is.

how do you take it apart, i have the factory nav if that changes anything

No that doesn't matter. Do you know how to take the top off of the center console? There are 2 screws under there (7mm hex cap IIRC) that hold the ash tray in, you take those out and it just slides out.

The top of the center console (the part the goes up around the sides of the ashtray) does just pop out. Insert a tool under it at each side of the ashtray (one side at a time) and just pull back towards yourself. Once the top is loose, just pull the rest of it up.
I had this failure on my 2004. We never used the ashtray. It just popped out by itself one day and wouldn't stay back in. It was replaced under warranty.
