Income Taxes

Although Harry's dancing around a good bit, he's actually telling the truth, SORTA. I'll not be specific either, for fear that I'll get somebody in trouble. However, the gist of it is this:
Some of the things we do tell the Govt. that we owe tax. If, after we say we owe, we don't pay up, they could come after you. Actually, even if you say 'yes' and then don't pay, the chances are that they won't come after you. There are simply too many who don't pay. They don't have enough personnel. On the other hand, if you get up on a soapbox and hold forth loudly, they'll get you just to teach a lesson.

Example---
The pedestrian has the right-of-way. Therefore, you can walk right out into traffic and be in the right. However, I suggest that you hold up one hand while doing so. That's to make it easier to get your coat off after they get you to the hospital. You may have the right-of-way, but you'll get your a-ss run over anyway.:D

The fact that they may lack the resources to prosecute EVERY tax violation doesn't mean it's voluntary. Often times, the IRS will audit lower middle class people because the tax code is so ridiculous you can always find or invent mistakes and they are less likely to be able to hire a competent tax attorney and fight any charges. It's easy money for the fed.

But in no ways is it voluntary. It's ordered at gun point.
The fact that you might get away doesn't negate that.

You misunderstand---I know of those who have successfully pointed out to IRS that they have never volunteered to be taxed, and have given the proper explanation of their position, and got a second letter---this time of apology---and agreement that nothing was owed. You do have to do things just right.

I was simply saying, above, that even if you owe and don't pay,the chances are good that you'll not be jumped on unless you are making a noisy fuss.

The IRS NEVER apologizes for what it does.
Despite the popular myth, there is no constitutional argument available that allows a person to opt out of the system. Ask Wesley Snipes how it worked out for him.

1. Contention: The filing of a tax return is voluntary.

Some assert that they are not required to file federal tax returns because the filing of a tax return is voluntary. Proponents point to the fact that the IRS itself tells taxpayers in the Form 1040 instruction book that the tax system is voluntary. Additionally, the Supreme Court’s opinion in Flora v. United States, 362 U.S. 145, 176 (1960), is often quoted for the proposition that "[o]ur system of taxation is based upon voluntary assessment and payment, not upon distraint."

The Law: The word “voluntary,” as used in Flora and in IRS publications, refers to our system of allowing taxpayers to determine the correct amount of tax and complete the appropriate returns, rather than have the government determine tax for them. The requirement to file an income tax return is not voluntary and is clearly set forth in sections 6011(a), 6012(a), et seq., and 6072(a). See also Treas. Reg. § 1.6011-1(a).
