Hey Guys, Can I get sued for this....

I stopped pymt on a check I wrote for a MarkVIII after dealer totally lied, I bought a Mark III from this dealer in Oakharbor OH, he was asking high buck too, one owner, clean, 46,700 miles (touted it all good, nothing wrong one owner)- like 6,500, I got him down to 5,100. Went on thursday to see, dealer insured me the car needs nothing they have serviced it and have checked it out completely, spent 3 hours discussing how reliable it is and how worth the extra money it is because it is in such good running condition back on saturday to buy, spent 2 to pick it up I checked her out but couldn't get all the way under her, and 4hrs travel time each trip.

Called dealer within in an hour going home about shake in front end, my guy not in, went straight to my mechanics when I got home, he couldn't see me till monday, went monday - he said it the undersideis totally rusted, everything under that car needs replaced. I attempted to contact my sales guy - unavailable each time so I stopped payment onthe check- can I get sued? I did try to call him and let him know, but they were closed, I plan oncalling tomorrow am.

Honestly, your legal ground is going to depent greatly on the state you live. In arizona, you have 15 day from purchase to get it checked out. (The No-lemon Law) I'm sure some states have similar laws, but I'm betting that in most, your just screwed once you pay. I would contact a lawyer. A good one will tell you straight out if you have a problem. You never know, maybe the dealership cares about its reputation and will work with you. There are some folks that still believe in the honest deal.
 
uh, all the lincoln mark viii have almost all alu parts on the under side

That is what I'm hoping, that is why I want to let himknow asap, hated to do it, but when I couldn't get a hold of him after getting her checked out, I was very concerned (he knew I was taking her to get checked). I was only able to find info on the lemon law here saying only for new cars.

school me - aluminum? my guy said it was like it sat in water, all the hoses were redy to go, and brake and fuel lines were needing replaced they were so rusted, in a short time I will spend a lot of money to get rid of asap.

I don't know much about the way they should, shouln't rust, I did notice rust under the passenger door, along the bottom seal, (my last one did that also).

I hope he is reputable, I asked him for a check list all their used cars go thru and he told me that they checked it out completely and she was clean, I even asked again and he assured me that hey found nothing wrong with it, it is in perfect condition -
makes me mad
 
here in NC you have 14 days for major purchases (house, car). Most people don't know about this and the dealers don't want you to know. CALL A LAWYER ASAP. I took a law class and the one thing i learned from that class is to contact a lawyer(a good one) anytime something like this occurs because there are so many different things about the law we as non-lawyers really don't know :q:q:q:q about the law, we just think we do or from what other people have told us, which ends up being wrong. You need a lawyer to look out for you.
 
Did the dealer give you an As Is Warranty paper?

The paper doesn't mean much at least a laywer could deal with it.

But if he didn't then I would guess that he'd be happy to work with you. He wants the money. Now you have the money. If you bring the car back he has what he doesn't want.

I would bet that he'll come down on the price, fix item, or take the car back.


Be strong and don't let him try to strong arm you. They will use many tactics.. You know those car salesman guys (Right Bryan :N ).

PM MonsterMark about this if he doesn't respond he'd know a bit more on what to do as he was a car salesman years ago.

Well I called him this am and he was really nice when I told him I took to get looked at and they said it is a rust bucket - he was telling me well it is a used car (totally different story now of course! before I bought it, prestine, like new, nothing wrong....BS!!!!). Then I told him I stopped payment - I think at that point he handed the phone over to his evil twin cause I was not talking with the same guy! He said "I'm not going around with you this car, I'm calling to see if the check was stopped I will call you back" click! I really thought he would try to work with me, but nope, he wants to dick somebody else with the nice looks and clean interior. Wish there was a way I could warn the next sucker!

He called back, didn't even say hi, just "bring it back today" I said I will have to see if I can find a ride back home, maybe not till tomorrow and told him I would call him later and let him know, he said that I have my money and his car that I needed to get it back to him asap. I have not called him yet, but I found a ride to follow me up then bring me back - this is the thrid time I've made this 4 hour trip now! And I looked that car over and over and over - guess thaht was the problem, I didn't look under!

Any one got a good reliable car for sale????????
 
really sorry that happened to you man. i bought my mark sight unseen on ebay and it was exactly as described.
 
You know.... As bad as it turned out, it could have been much worse. At least you got your money back. What was the name of that dealer? so none of us get screwed..... I hope that you do find the car you are looking for.
 
F'n BASTIDS... Make sure you go during the morning like 10-11am. There oughta be people in the waiting room... Make a scene... Dickheads, they cost you 12 hours of your time!!!!

I had been going to my local Lincoln dealer for a coupla years for service and found out (ONLY THRU JOINING LVC) that this particular dealer was ripping me off bigtime for parts... Basically throwing a 20% mark up on their already rediculous price. Upon making a few calls to ONEBADMK8, and admin on our site who happens to have family working at a Dealership, I found the "Real" dealer price. ($140 part turned into only $90)

So I called my service guy and instantly told him that he was overcharging me for the parts and I have a quote from another dealership, indicating the prices above. All of a sudden... The Service Manager is on the phone with me... "Well, we can give you a 20% discount on parts and perhaps some labor..." Which they were quoting 2 hours on a blower moter speed control unit right behind the glovebox that took me only 15 minutes to do... A job that a trained tech could do in 15 seconds... UGH!

I told them to cancel everything... Did a 30 second brake burn out in the TC they loaned me (which smoked the entire parking lot at my job) Got to the dealership and proceeded to speak to the service manager, in front of the waiting room, very loudly about how he was jacking up the prices on parts and how other dealerships quoted me prices for the same parts that were almost 40% cheaper??? He said in front of the others... 'That is impossible' and I responded loudly by saying IT IS POSSIBLE, AND I HAVE QUOTES... LETS CALL THE OTHER DEALERSHIP NOW.... They'll provide the quote to you!!!!!! People started to look at each other!!! There were 5 people waiting. 3 Old men and 2 30-something women... Very professionally, I said to him... I have been a loyal customer to this dealership and service department and to find out that you have been screwing me for years really hurts... I bet they lost 5 other customers that day!

So, F it... Make a scene, least you can do to those gerks who were tying to beat you!
They're 4 hours away, you won't know anybody there!!!!!

Good luck... Oh, find out the car of the dude who sold you and stick a phat wad of chewing gum on the underside of his driver door handle... Trust me he'll know who put it there!!!!! God I hate when they try to rip you off!!!!!!!!!
 
Yeah, my old man works for a Ford dealership and has for 30+ years. Salesmen like this guy- they REALLY piss him off; and give him a bad name. One rule of tumb he told me was nevr go to a dealership that sells vehicles older that 3 years. Older cars like the one that you bought bring trouble; and you already know that.

I guess we all learned a valuable lesson; when buying a used or new car; check everywhere, including under the car...

I know of a very nice 94 for sale about 80K miles.

I'd make him pick it up! Just tell him where he could meet you. "Not at your home". And have a large size Bubba with you for intimadation!!
 
LOVE YOU GUYS!!!!!!!!!!!!! You sure can cure the a__hole blues, I was wearing the dumb blonde hat bashing myself everytime I thought about it!!! Like ya all said, thank God I got my money back and when you go to look at a car get your body dolly outta the bedroom and take it with you!

Dealership is Tri Motors in Oak Harbor, they have two locations in that areaI

Yeah, I thought he was going to tell me he was pickin it up, no worries the 400 I put on it rolled it over to 47,000, he has to eat the adds with 46,500!

Got a curious question, I did a title search on it and it sat from 3/03 till she was bought 6/04 - is that normal, I thought that was odd.

Again, YOU GUYS ARE THE BEST, give great advice and Jammler3 love the rippen a new booty for the dealer story - mind if I keep your info and drop you a line when I need a bubba?
