so i have this 97 sts sitting at crappytire.waiting to be towed back to the dealership for the 6th time at least. I cant drive it without the engine smoking. they said i need new engine and the work that was apparently done is now worse then b4. Anyhow..
The dealership is trying to say that it doesnt withstand unless i take it to gm and get them to diagnose it!! Is this true ????
 
I'm not sure I know what you mean by "withstand." If you mean the dealership will not work on the car until you bring it to some GM facility, that is contrary to what I understand is the normal protocol.

A GM/Cadillac dealership will have GM certified technicians that will be able to diagnose problems and the manager or somebody will determine if it's covered by warranty. At least, this is what I understand is the usual protocol.
 
Makes sense except for....

i bought the car used out of the auto trader with the dealership being some crummy shop not an actual GM dealership. DOesnt that make a difference??

Your best bet may be your state’s lemon law. For example New Jersey's Lemon Law states that a used car dealership must guarantee that any car it sells will pass state motor vehicle inspection. Also, in NJ, there are lemon laws which state, to my recollection, that a dealer must warranty the drive train and suspension and various other parts for the first 30 days or 1000 miles, whichever comes first.

Thank u for ur input. The first week or two we had to have them put in a new engine. Did not get any papers for new warrenty. They said 6 month warrenty now. Its not been 6 months yet. I do know that by law 90 days for sure, but its been longer then that. They are basically tring to say that canadian tires report isnt good enough for them to install a new engine. Yet the first time they put the engine in was okay...lol . CAA gold has run out of tows now we're wondering if they should pay for the towings ??
 
What exactly does the warranty say? It will explain your rights and the dealership's obligations? And you may have more rights under Canadian law. Next, you should make sure you have written proof that you brought the car back within the specified engine warranty period in case the dealer decides to try to bail out of it's obligations under the warranty. I would not be surprised if the dealer is required by law to provide you a written copy of the warranty. It's ridiculous to say the engine is warranted for 6 months and not know exactly what that means. Once you know what the warranty says you'll be in a better position to make decisions. The warranty may provide information on what constitutes sufficient proof to determine if the engine is defective. In other words, Canadian Tires Report (which I gather is a diagnostic report) may be sufficient to invoke certain rights under the warranty. (?)
