You really don't understand what "constitutional" means, do you. A constitutional amendment can not be "unconstitutional".
Until you can explain it in concrete terms, no one can understand what you mean by a "small town mindset".
I understand "gray" and I understand when someone is trying to exaggerate or down right manufacture a false "gray" area. You said it yourself, you "need gray on this". In smaller towns people all (mostly) know each other better which makes them more like a big family.
